By accessing or using our website at mortgagedefender.net (the "Site") or purchasing any of our insurance products, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Site or services.

Mortgage Defender is a trade name ("DBA") of Contractor Benefits Group, a licensed insurance agency. Throughout these Terms, references to "Mortgage Defender," "we," "us," or "our" refer to Contractor Benefits Group, doing business as Mortgage Defender.

1. Definitions

  • "Services" refers to mortgage protection insurance products and related services offered by Contractor Benefits Group DBA Mortgage Defender.
  • "User," "you," or "your" refers to any individual or entity accessing or using our Site or Services.
  • "Policy" refers to an insurance policy underwritten and issued through Contractor Benefits Group DBA Mortgage Defender.
  • "Policyholder" refers to an individual who has purchased and holds an active insurance Policy through us.

2. Eligibility

By using our Site or Services, you represent and warrant that you are at least 18 years of age with legal capacity to enter a binding contract; that all information you provide is true, accurate, current, and complete; that you will keep such information updated; that you are a U.S. resident or otherwise eligible to purchase our products; and that your use complies with all applicable laws.

3. Insurance Products and Services

Mortgage Defender, through Contractor Benefits Group, offers mortgage protection insurance products including Mortgage Life Insurance (Death Benefit), Mortgage Disability Insurance, Critical Illness Coverage, and Comprehensive Mortgage Protection Bundles.

Important: All insurance products are subject to underwriting approval. Coverage availability, terms, conditions, exclusions, and limitations may vary by state and individual circumstances. Nothing on this Site constitutes a binding offer of insurance coverage. A formal Policy is only created upon approval of your application, payment of the required premium, and issuance of a policy by the underwriting insurance carrier. Premium quotes are estimates based on the information you provide and are subject to change based on final underwriting review.

4. Quotes and Applications

When you request a quote or submit an application, you authorize us to collect, use, and verify the information you provide for underwriting and quoting purposes; you consent to being contacted by Mortgage Defender or Contractor Benefits Group via phone, email, text message, or mail regarding your quote or application; you acknowledge that providing false, misleading, or incomplete information may result in denial of coverage, policy rescission, or denial of benefits; and you acknowledge that submission of an application does not guarantee approval or issuance of a Policy.

5. Intellectual Property

All content on this Site is the property of Contractor Benefits Group DBA Mortgage Defender or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. The "Mortgage Defender" name, logo, and related marks are trademarks of Contractor Benefits Group. You are granted a limited, non-exclusive, non-transferable license to access the Site for personal, non-commercial use only.

6. User Conduct

You agree not to use the Site for any unlawful purpose; attempt unauthorized access; interfere with or disrupt the Site; use automated means to scrape data; transmit viruses or harmful code; impersonate any person or entity; or send unsolicited commercial communications (spam).

7. Disclaimer of Warranties

The Site and all content and services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that insurance coverage will be available or approved for any particular applicant.

8. Limitation of Liability

To the fullest extent permitted by law, Contractor Benefits Group DBA Mortgage Defender and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or Services. In no event shall our total aggregate liability exceed the amount you paid to us, if any, for the specific Service giving rise to the claim during the twelve (12) months preceding the event.

9. Indemnification

You agree to indemnify, defend, and hold harmless Contractor Benefits Group DBA Mortgage Defender and its affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Site or Services, your violation of third-party rights, or any misrepresentation you provide.

Our Site may contain links to third-party websites we do not control. We assume no responsibility for the content, privacy policies, or practices of any third-party websites.

11. Privacy

By providing your contact information through our Site, you consent to receiving communications from Mortgage Defender and Contractor Benefits Group, including quote and follow-up communications, policy-related notices, marketing and promotional materials, and customer service communications. You may opt out of marketing communications at any time by following the unsubscribe instructions in our emails, replying STOP to text messages, or contacting us directly. You may not opt out of transactional or legally required communications.

SMS/Text Messaging Program. If you provide your mobile phone number and opt in (for example, by checking the SMS consent box on our quote form), you agree to receive recurring automated text messages from Mortgage Defender (Contractor Benefits Group) regarding your mortgage protection quote, appointment scheduling and reminders, and policy service. Message frequency varies. Message and data rates may apply. Reply STOP to any message to unsubscribe at any time, or reply HELP for help. Consent to receive text messages is not a condition of purchasing any product or service. We do not sell, rent, or share your mobile phone number or SMS opt-in information with any third parties or affiliates for their own marketing or promotional purposes.

13. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Washington, without regard to conflict of law principles. You agree to first attempt to resolve any dispute informally by emailing scott@mortgagedefender.net. If unresolved within sixty (60) days, either party may initiate binding arbitration administered by the American Arbitration Association in Yakima County, Washington. You agree that any arbitration or proceeding shall be limited to the dispute between us individually, and you waive participation in any class or representative proceeding.

14. Modifications to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Site or Services after modifications constitutes acceptance of the revised Terms.

15. Termination

We may terminate or suspend your access to the Site or Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

16. General Provisions

  • Severability: If any provision is unenforceable, it shall be limited or eliminated to the minimum extent necessary, and the remaining provisions remain in effect.
